Terms of Service
Effective August 20, 2026
These are the terms that govern your use of avalougheed.com and any presale reservations placed through the site. By using the site or placing a deposit, you agree to these terms.
Ava Lougheed ("we," "us," "our") is a sole proprietorship based at 2468 Adanac Street, Vancouver, British Columbia, Canada.
The presale
We are producing a limited run of 300 pairs. You can reserve a pair by placing a refundable $25 USD deposit through our secure Stripe checkout.
The final price is expected to be approximately $150 USD. We'll confirm the final price before asking you to complete your purchase at launch. If the final price ends up higher than expected and you'd rather not proceed, we'll refund your deposit in full.
Your deposit is $25 USD. It is fully refundable at any time before your shoes ship. When you complete your purchase at launch, the deposit is credited toward the total price.
Completing your purchase. When the drop launches, we'll email you an invitation to pay the remaining balance and confirm your size and shipping address. We'll hold your reserved pair for a reasonable period after that invitation, and we'll tell you the exact window in the email. We hold deposits until the drop ships or stock runs out. If we don't hear from you or your payment doesn't go through, we'll release your reservation to the next person on the waitlist and refund your deposit to the card you used.
Cancellation and refunds
You can cancel your reservation and request a refund of your $25 deposit at any time before your shoes ship, for any reason, by emailing privacy@avalougheed.com. Refunds are issued to the original payment method through Stripe, typically within 5–10 business days.
You may also have statutory cancellation rights under British Columbia's Business Practices and Consumer Protection Act for distance sales. This policy is intended to meet or exceed those rights.
Delivery
We expect to ship in Fall 2026, subject to production timelines. Small delays are possible with a handmade product; if we run significantly behind schedule, we'll email you and give you the option to keep waiting or take a refund. Shipping costs, and any applicable duties and taxes, will be shown before you complete your purchase at launch.
The shoes
Every pair is made by hand at a small, family-run factory. Small variations in colour and finish are a feature of the craft, not a defect. If a pair arrives with an actual defect, we'll make it right — repair, replace, or refund.
Your information
You're responsible for giving us an accurate name, email, and shoe size, and for keeping your contact details current so we can reach you at launch. See our Privacy Policy for how we handle your information.
Using this site
You may use the site for your own personal, non-commercial purposes. You may not:
- copy, reproduce, or resell content (photos, copy, design) from the site;
- attempt to break, overwhelm, or gain unauthorized access to the site or its systems;
- use the site in a way that breaks the law.
All content on the site — including photos, illustrations, product designs, text, and the Ava Lougheed name and logo — is our property or is used with permission. Nothing here grants you a right to use it beyond viewing the site.
Third-party services
Payments are processed by Stripe, Inc. and are subject to Stripe's own terms. The site is hosted on Railway. We aren't responsible for the acts or omissions of third-party services beyond our reasonable control.
Limitation of liability
To the fullest extent permitted by applicable law, our total liability to you for anything arising out of the site or a reservation is limited to the amount you paid us (typically $25 USD). We're not liable for indirect, incidental, or consequential losses. Nothing in these terms limits liability that cannot be limited by law, including under BC consumer protection legislation.
Governing law
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply here. Any disputes will be resolved in the courts of British Columbia, unless BC or federal consumer protection law gives you the right to proceed elsewhere.
Changes
If we change these terms, we'll update the effective date above. Reservations already placed continue to be governed by the terms in effect when you placed them.
